TRANSCRIPTION: This deed made this 18th day of April 1820 between Edward Stratton of the County of Northampton of the one past and John E. Nottingham & Caleb B. Upshur of the same place of the other part witness, that the same Edward Stratton for & in consideration of the sum of one thousand two hundred dollars to him in Land paid by the said John E. Nottingham & Caleb B. Upshur at or before the sealing & delivery of these presents the receipt where of is hereby acknowledged has bargained, sold and conveyed & by these presents does bargain, sell and convey to the said John E. Nottingham & Caleb B. Upshur Two lots or parcels of land situate lying and being in the town of Eastville in the County of Northampton, the one containing four acres & bounded on the north by a street of said town, here in after to be described separately the said lot from a lot belonging to the heirs of Dr. James Lyon dec'd on the East by the main street of said town and on the South and West by the lands of the said Edward Stratton. The other adjoining the Public or Court House lot in the north and west, the main street of the said town on the east and the lot belonging to the heirs of Dr. James Lyon on the south & containing three eighths of an acre by the same more or less what said last mentioned lot to the same formerly accquired by James Johnson dec'd & in which the said James Johnson erected a stone house & warehouse & now in the occupancy of Edward Roberts. And its furhther covenanted by the said Edward Stratton that there shall be a street laid off between the front described bargain & sold lot belonging to the heirs of Dr. James Lyon dec'd which said street shall run parallel with the said lots through the whole easterly & westerly extent of the same & be thirty feet wide at the least & the said street shall be used and enjoyed by the citizens of Eastville and the public at learge forever as a common street and public highway. To have & hold the said bargained & sold lots on parcels of land together with all the houses, prilidges & appurtenances to the same belonging or appertaning to the said John E. Nottingham & Caleb B. Upshur, their heirs & assigns forever to their only proper use & beautiful, & to no other use intent or purpose whatever. Should the said Edward Stratton does hereby further covenant & agree to & with the said John E. Nottingham & Caleb B. Upshur that he the said Edward Stratton & Mary Anne his wife who is now under the age of twenty one years & incapable of conveying the said lots so as to be obligatory upon her, & all & every other persson or persons having or claiming little to or in the said lots or parcel of land shall & will on or before the 1st day of September 1823, make do & execute all & every such further & other lawful acts & these devices, deeds & conveyances & aparances in law whatsoever, for the more perfectly conveying & aparing a good sufficient & perfect title in the lots above mentioned with their houses inprovements & appurtenances, unto the said John E. Nottingham & Caleb B. Upshur their heirs or assigns forever in full & perfect fee simple as by the said John E. Nottingham & Caleb B. Upshur their heirs or assigns shall be devised or required. Should the said Edward Stratton hereby build himself his heirs Executors & administrators, the said lots or parcels of land together with all the right priveldges & appurtenances to the same belonging to the said John E. Nottingham & Caleb B. Upshur, their heirs & assign, free from all incumbrances whatsoever & free from the claims & demands of all persons whomsoever, to warrant & forvever defend by these presents. In testimony whereof the said Edward Stratton has hereunto set his hand & affixes his seal the day & year first above written. Signed sealed & delivered in the presence of Smith Nottingham, George Teackle, Harold L. Wilson, William Dunton. Edward Stratton (seal). At a Court held for Northampton County the 10th day of July 1820 this deed was proved by the oath of Smith Nottingham, Harold L. Wilson & William Dunton witnessed thereto, & ordered to be recorded.
